These terms set out what a Canadian Locals page and plan are, what the plan costs, how to stop it, what you may put on your page, and where our responsibility ends.
1. Who these terms are between
These terms are between Canadian Locals, run by Josh Gonzales at canadianlocals.ca ("Canadian Locals", "we", "us"), and you.
"You" is anyone who uses canadianlocals.ca or our apps. Where a section is about a business page or a plan, "you" is the person acting for that business, and the business too.
By using Canadian Locals, or choosing a plan, you agree to these terms. They work with our Privacy Policy, which explains how we handle information.
2. What Canadian Locals is
Canadian Locals is a directory of independent, Canadian-owned businesses. It helps people find those businesses, and it helps the businesses be found. It includes:
- business pages;
- person pages for the people behind a business;
- a scan app that shows who owns a product's brand;
- Posts, a writing assistant for business owners.
3. Business pages
How a page starts. We build many pages from public sources, such as local business associations and the business's own website. Every page is reviewed before it appears.
Who belongs here. A business belongs in the directory only when it is independent and Canadian-owned: more than half of its voting shares or control rests with Canadian citizens or permanent residents, it is a small or medium-sized enterprise by Statistics Canada's definition, and it is not a franchise of a global chain. We ask each business to confirm this, and a business that is not leaves the directory.
Eligibility is not for sale. No plan, price or arrangement changes whether a business meets that test.
Corrections cost nothing. If something on a page is wrong, write to hello@canadianlocals.ca and we fix it, whether or not the business has a plan.
Taking a page down. A business can ask us to take its page down at any time. We do it the same day.
Owning a page. To edit a page, you show us you are connected to the business, in one of the ways our Privacy Policy describes. Each business has one owner account. Whoever the business authorizes may hold it, and you promise you are authorized.
4. Your account
We create your account for the email address you use when you tell us you would like your page listed, or when you pay for a plan. You choose the password.
Keep your password to yourself. You are responsible for what is done with your account. Tell us straight away if you think someone else has used it.
Keep your details current, so we can reach you about your page and your plan.
5. The plan
The first 30 days. When we email you the plan link, your 30 days start. There is nothing to pay during them, and you do not need to do anything. Our email and your plan page show the date they end.
After 30 days, your page stays in the directory only with a plan. Without one, the page leaves the directory, and you owe nothing.
What the plan costs:
- $149 a year or $25 a month, in Canadian dollars, plus tax;
- one person page is included; each further person page is $5 a month or $50 a year, plus tax;
- $20 off the first year of the yearly plan when you choose it within seven days of the day we send you the plan link, counting that day; our email names the last day.
How you pay. You pay through Stripe, our payment company. We collect the sales tax that applies where you are, and send you a receipt for each payment.
Your plan renews at the end of each month or year, until you cancel. We charge the card on file on the renewal date.
If a payment fails, your page stays up for up to 23 days while the payment is sorted out. After that, the plan ends and the page leaves the directory.
Adding or removing an extra person page during a billing period is prorated: the change for the days left appears on your next payment.
6. Cancelling, and price changes
Cancel any time with "Manage your plan" on your plan page, or by writing to us. Your plan runs to the end of the month or year you have paid for, and then stops. Your page leaves the directory at that point. For a year after, choosing a plan on your plan page brings it back.
If our prices change, we tell you by email at least 30 days before the new price applies to you. It applies at your first renewal after those 30 days, and you can cancel before then.
7. Refunds
We do not give refunds, except where the law requires one or where section 14 applies. Cancelling stops the next payment, and what you have paid for runs to the end of its month or year.
8. What you put on your page
It stays yours. You keep ownership of the text, photos, logos and links you add.
You let us use it to run Canadian Locals. You give us a licence to show, store, copy, resize and format what you add, on our site, in our apps and in things that promote your listing. You can still use it anywhere else, and we do not pay you for it. The licence ends when you remove the content, or when your page leaves the directory, apart from copies in backups and records we must keep.
You promise that what you add:
- is accurate, and is yours to use or used with permission;
- is not unlawful, misleading, hateful or harassing;
- does not infringe anyone's copyright, trademark or privacy;
- does not include anyone else's personal information without their permission.
We may remove content, or a page, that breaks these terms, or that makes a business look independent or Canadian-owned when it is not. We tell you why, unless the law prevents it.
9. Posts, the writing assistant
Posts writes draft posts from your business facts and your writing. The drafts are written by an AI model and can be wrong. You review every draft before you use it, and you are responsible for what you publish.
We do not publish anything for you. The Privacy Policy explains what Posts sends to our AI providers.
10. The scan app
The scan app shows who owns a product's brand. It uses Open Food Facts, a public database under the Open Database Licence, and our own ownership records. Ownership changes and records can be incomplete. Use the result as a guide, not a guarantee. If you think a result is wrong, write to us with what you know.
11. Using Canadian Locals fairly
When you use Canadian Locals, you will not:
- copy the directory in bulk, or scrape it;
- try to get into accounts, data or systems that are not yours;
- interfere with how Canadian Locals runs;
- pretend to be a business or a person you are not;
- use it to send spam.
We may suspend or close an account that does.
12. What we can promise
We work to keep Canadian Locals accurate and running, but we provide it "as is". We do not promise that it will always be available or without error, or that it will bring a business any particular number of customers.
13. Limits of responsibility
- We are not responsible for indirect losses, such as lost profits.
- Our total responsibility to a business is limited to what it paid us in the 12 months before the claim.
- Nothing in these terms limits a responsibility the law does not allow us to limit.
14. Ending
You can stop using Canadian Locals at any time, and ask us to take your page down and delete your account.
We can end your account, or take a page down, if you seriously or repeatedly break these terms. If we end a plan for any other reason, we refund the unused part.
These parts continue after the end: ownership of your content (section 8), refunds already due (section 7), and the limits of responsibility (sections 12 and 13).
15. Changes to these terms
When we change these terms, we update the date at the top of this page. For a change that affects your plan or your rights, we tell you by email at least 30 days before it applies. If you do not agree, you can cancel before then.
16. Law and disagreements
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. If we disagree about something, write to us first. We will try to sort it out with you within 30 days.
